Court of Appeal of Potenza, 27 October 2025, No. 368

The challenge for nullity of an arbitral award is not equivalent to an act of appeal, being designed to render void the entire award, with effect also on the determinations not explicitly challenged. It follows that the decision on the merits, after allowing the challenge with the declaration of nullity of the arbitral award, must address and resolve all the issues previously submitted to the arbitrators, even if not expressly re-raised.
