Legal Principle
Where the arbitration clause was entered into before the amendments introduced by Legislative Decree No 40 of 2 February 2006, the challenge of the award for breach of the rules of law is admissible pursuant to Article 829(2) of the Code of Civil Procedure in its former version, since the law applicable for the purposes of Article 829(3) of the Code of Civil Procedure is that in force at the time the arbitration agreement was concluded.
