Legal Principle
The assessment of the existence and persistence of the conflict of interest that led to the appointment of a special curator of a party to arbitral proceedings falls within the jurisdiction of the arbitral tribunal and, subsequently, of the court hearing any challenge to the award, the decree appointing the special curator not being independently appealable by way of complaint pursuant to Article 739 of the Code of Civil Procedure.
