Arbitration case law

sentenza

Court of Appeal of Naples, 26 November 2025, No. 6012

Corte di Appello of Napoli

Legal principle

Where there are multiple connected claims, only some of which fall within the scope of an arbitration clause, the arbitral jurisdiction is absorbed and excluded by that of the ordinary court, by reason of the requirement of simultaneus processus and the natural prevalence of state jurisdiction over arbitral jurisdiction. [PER INCURIAM]

Methodological notes

per incuriam
