A stay of the enforceability of an award under art. 830, co. 4, cod. proc. civ. presupposes serious grounds, to be assessed both as regards the likely merits of the challenge, following a summary appraisal reserved to the court hearing the challenge and without prejudice to full examination at the decision stage, and as regards the periculum in mora.
For the purposes of staying the enforceability of an award, the substantial amount of the monetary order is not sufficient, there being required the specific pleading of a prejudice going beyond that naturally inherent in enforcement.
