The challenge of an arbitral award before the Court of Appeal is subject to the ordinary procedural rules of civil proceedings, so that the failure of the parties to appear at the hearing fixed for referring the case to the panel and at the subsequent hearing fixed pursuant to Article 309 of the Code of Civil Procedure results in the removal of the case from the list and the declaration of abatement of the appeal proceedings.
