Court of Appeal of Lecce, 24 March 2026, No. 314

An arbitration clause contained in a construction contract covers contractual disputes, including those arising from the performance of the contract.
A trustee in bankruptcy who pursues credits arising from the contract containing the arbitration clause is bound by that clause. For the purposes of delimiting the scope of the arbitration clause, a distinction must be drawn between contractual and extra-contractual claims.
