An arbitral award, whilst not having binding effect on parties who did not participate in the arbitral proceedings, may have indirect evidential effect or serve as documentary evidence regarding the legal situation which was the subject of the arbitral determination, it being for the trial judge to freely assess its content in relation to other elements of judgment.
