Court of Appeal of Catanzaro, 10 July 2025, N. 757
Corte di Appello
di Catanzaro
Legal Principle
An arbitration clause presents a dual limitation: one on the subjective plane, concerning only disputes arisen between the subscribing parties specifically indicated, and the other on the objective plane, relating exclusively to disputes which involve interpretation of the instrument or activities specifically provided for therein. There are excluded both disputes which concern persons other than the subscribers, and disputes which relate to aspects not expressly comprehended within the scope of application of the clause.
