An arbitral tribunal that raises an issue of its own motion, such as the termination of the contract by mutual consent, without submitting the issue to the parties and without granting the time limit provided for by Article 101, paragraph 2, of the Code of Civil Procedure, incurs a defect constituting a serious ground for the suspension of the effectiveness of the award under Article 830, paragraph 4, of the Code of Civil Procedure.
