Legal Principle
Where an arbitration clause provides for the referral of disputes to international arbitration with a seat abroad, the national court lacks jurisdiction and may not review the validity or effectiveness of the arbitration clause, since that review falls exclusively within the competence of the arbitrators, and the resulting decision may be challenged only through the remedies available at the stage of recognition of foreign awards.
