Court of Appeal of Ancona, 5 September 2025, No. 1078

The challenge of an arbitral award is subject to restricted review and does not permit examination of the merits of the facts established by the arbitrators, given that the supervising court’s jurisdiction in challenge proceedings is limited solely to the defects provided for by law, excluding any re-evaluation of factual issues which would constitute a violation of the prohibition against unrestricted review of the award.
