Legal Principle
A non-final arbitral award that merely rejects preliminary or procedural objections without partially deciding the merits of the dispute is not immediately subject to challenge under Article 827, paragraph 3, of the Code of Civil Procedure. Immediate challenge is reserved exclusively for awards that pronounce generic condemnation pursuant to Article 278 of the Code of Civil Procedure or that decide one or some of the claims submitted without concluding the entire arbitral proceedings.
