The challenge for nullity of an award that censures the lack of specificity of the ground of appeal is inadmissible when it does not comply with the burden under art. 366 no. 6 of the Code of Civil Procedure, where the appellant merely asserts generically the specificity of the ground without indicating precisely the content of the award's reasoning that is allegedly not considered.
The challenge for nullity of an award based on failure to rule is inadmissible when the arbitrator has actually ruled on the objection and the censure actually aims to contest on the merits the evaluation made by the arbitrator himself.
