The irregular composition of the college referee because performed in defect in some of the components of a condition pactive foreseen can be made worth as Reason of nullity ai senses of art. 829, co. 1, n. 2 cod. proc. civ. and therefore only at condition that the relative question it is already deduced in the judgment arbitration.
