Legal principle
Jurisdiction to determine an application for the appointment of an arbitrator lies with the President of the Court of the place identified by the parties as the seat of the arbitration.
Where a party, having been duly invited by notice of the appointment of the other party's arbitrator, fails to notify in writing the designation of its own, the President of the Court appoints the party-appointed arbitrator under art. 810 cod. proc. civ., in relation to the arbitration proper which the applicant has stated its intention to commence.
