Legal Principle

The arbitrator's right to remuneration for the activity carried out arises from the mere fact of the actual performance of the mandate, regardless of the pendency of proceedings challenging the arbitral award.
The remuneration due to arbitrators who also hold the qualification of advocate must be assessed on the basis of the professional tariff for advocates, without the possibility for the president of the court, in the assessment pursuant to Article 814 of the Code of Civil Procedure, to resort to equitable criteria or other criteria.
In the case of an arbitral tribunal composed of advocates, each member is entitled to full remuneration for the activity performed, and a single remuneration to be apportioned among the members of the tribunal may not be assessed.
