A claim founded on unjust enrichment, which is not in the nature of a claim for performance of the contract, does not fall among the disputes referred to the arbitral tribunal by an agreement submitting to it the disputes concerning the application or interpretation of the contractual agreement; the objection that the ordinary court lacks cognizance in favour of the arbitrators must therefore be dismissed.
