Court of Trani, 2 January 2026, n. 2
Tribunale
di Trani
Legal Principle
The plea of arbitration agreement raised by the defendant in ordinary proceedings, aimed at asserting the existence of an arbitration clause, does not automatically result in the acceptance of the related plea of lack of jurisdiction, as the court must assess whether the claim brought effectively falls within the objective scope of the arbitration agreement, with particular reference to the specific matters contemplated therein in relation to the relief sought.
