In the case of opposition founded on existence of a clause compromise, the judge of the opposition must declare the incompetence of the judge which has emitted the decree e arrange the remission of the C ONTROVERSIA AL JUDGMENT of the Referees (in the case of arbitration ritual) or declare the impossibility of the application (in the case of arbitration irritation) and in each case declare the nullity of the opposite decree.
