The ordinance rendering by the judge state, that rejects the exception of competence per being this attributed to a court arbitral, not defining the judgment, may and must be challenged to senses of art. 42 of the Italian Civil Code proc. civ. with request of regulation of competence within i terms provided from the aforementioned provision.
