Legal Principle
Even in the presence of an arbitration clause submitting the dispute to arbitrators, the party retains the power to apply to the ordinary court for interim relief pending the appointment and acceptance of office by the arbitrator, as the provision for arbitral jurisdiction does not constitute an obstacle to access to state interim relief jurisdiction pending the constitution of the arbitral tribunal.
