Legal Principle

In the event of failure by a party under an obligation to appoint an arbitrator, the President of the Court, acting pursuant to Article 810 of the Code of Civil Procedure, shall appoint the arbitrator in a substitutive capacity, exercising an administrative power aimed at ensuring the constitution of the arbitral tribunal and the effectiveness of the conventionally agreed protection.
