Legal Principle
An arbitration clause contained in a works contract, which refers to arbitration any dispute arising out of or in connection with the contract, excludes the jurisdiction of the court also in respect of claims for payment of retention monies. The court, having ascertained that the arbitration clause applies, must decline jurisdiction in favour of the arbitral tribunal.
