Legal Principle
The provision set forth in article 2945 of the Civil Code concerning the interruption of limitation periods applies also to arbitral proceedings, with the consequence that the filing of an arbitral claim interrupts the running of the limitation period for claims brought in the proceedings.
The interruption of the limitation period effected by the filing of an arbitral claim extends its effects, by application of article 1310 of the Civil Code, also against subjects jointly and severally liable with the subject against whom the arbitral claim was filed.
The limitation period remains suspended, pursuant to article 2943 paragraph 4 of the Civil Code, until the date of filing of the judgment of the Court of Cassation that defines the proceedings for challenge of the arbitral award.
