Legal Principle
The objection of inadmissibility of the court proceedings based on the failure to follow the preliminary arbitration procedure provided for by an arbitration clause in the articles of association must be dismissed where the articles of association in force at the time the dispute arose, including following any subsequent amendments, do not contain any arbitration clause.
