In matters of corporate arbitration, the power of arbitrators to issue interim measures must be expressly conferred by the parties either through the arbitration agreement or by written instrument prior to the commencement of arbitral proceedings, pursuant to Article 818 of the Code of Civil Procedure; in the absence of such express attribution in the arbitration clause, applications for interim relief fall within the jurisdiction of the competent ordinary court pursuant to Article 669-quinquies of the Code of Civil Procedure.
