The suspension of limitation provided for during the conduct of contractual arbitration (arbitrato irrituale) proceedings does not operate where such proceedings, being contractual and optional in nature, are not accepted by the opposing party through the appointment of its own arbitrator, with the consequence that the arbitral proceedings never commence and the limitation period continues to run.
