Where the contractual terms provide for the designation of one expert by each party and, in default of performance or of agreement, for the appointment of the third expert by the President of the Court, that appointment is made under art. 810 cod. proc. civ.
Jurisdiction to determine the application for appointment lies, by virtue of the contractual stipulation, with the court territorially identified by reference to the residence of the insured party.
