Legal Principle
In the absence of agreement between the parties on the determination of the fees payable to the arbitrator, the assessment pursuant to Article 814, paragraph 2, of the Code of Civil Procedure must be carried out on the basis of criteria of reasonableness, having regard to the value of the dispute, the nature and complexity of the appointment, and the work actually carried out by the arbitrator in the course of the arbitral proceedings, reference being permitted, by way of analogy and without binding force, to the tariff criteria applicable to the legal profession, adapted to the specific nature of the arbitral appointment.
The fees payable to the secretary of the arbitral proceedings, in the absence of an independent tariff, must be determined on an equitable basis, having regard to the procedural support work actually performed in the course of the arbitration.
