The objection of lack of jurisdiction of the ordinary court in favour of the arbitral tribunal, based on the arbitration clause contained in the special conditions of contract, must be rejected where the claim concerns rights arising after the termination of the contractual relationship and founded on an autonomous ground, such as unjust enrichment, such disputes not falling within the scope of application of the arbitration agreement which submits to arbitrators only disputes arising from the termination of the contract.
