Court of Milan, 28 October 2025, No. 8141
Tribunale
di Milano
Legal Principle
An arbitration clause that limits recourse to the ordinary courts to invoices relating solely to goods received without objection does not preclude the granting of a decree for payment when the debtor's objections relate to supplies different from those covered by the invoices in question, or when the objections are generic and insufficient to specifically identify the disputed supply.
An arbitration clause that permits recourse to judicial authority to demand payment of invoices without further limitations is not derogated by the provision for recourse to arbitration for disputes relating to the validity and performance of the contract.
