Legal Principle
An arbitration clause does not preclude the ordinary courts from issuing an order for payment, but where the debtor raises the objection of arbitral jurisdiction in opposition proceedings, the court must declare its lack of jurisdiction, set aside the payment order and refer the parties to the arbitral tribunal.
