Legal Principle
The plea of arbitration raised by a third party who has intervened by way of dependent ancillary intervention (intervento adesivo dipendente), having entered an appearance after the time limit under Article 166 of the Code of Civil Procedure, is out of time and results in forfeiture pursuant to Article 167(2) of the Code of Civil Procedure, in that preliminary pleas — including those based on the existence of an arbitration agreement — must be raised within the time limits prescribed for the appearance of the original parties to the proceedings.
