Court of Milan, 11 September 2025, No. 6826
Tribunale
di Milano
Legal Principle
An arbitration clause contained in a contract does not automatically extend to legal relationships arising from subsequent contracts, even where such subsequent contracts are connected to the previous transaction, if the original contract now constitutes merely a historical antecedent and the arbitration clause makes no reference, whether direct or indirect, to the subsequent contracts. The principle of autonomy of the arbitration clause entails its restrictive application, limiting its effectiveness to the transaction alone in which it is incorporated, save where otherwise specifically provided.
