Legal Principle
The electronic filing of the arbitral award and the arbitration agreement, accompanied by an attestation of conformity to the original, is equivalent in all respects to filing with the court registry for the purposes of the exequatur proceedings provided for by Article 825 of the Code of Civil Procedure.
For the purposes of the declaration of enforceability of an institutional arbitration award pursuant to Article 825 of the Code of Civil Procedure, the court is required to verify exclusively the formal regularity of the award, the non-manifest absence of the arbitration clause and the absence of any manifest provision for foreign arbitration, without extending its review to the merits of the arbitral decision.
Territorial jurisdiction for exequatur proceedings relating to an institutional arbitration award lies with the court of the place where the arbitration has its seat, as determined in the arbitration agreement or in the course of the arbitral proceedings.
