Legal Principle
An arbitration clause providing for informal arbitration is valid and effective without need for specific written approval under Article 1341(2) of the Civil Code, both because such provision applies exclusively to general contract terms drafted to regulate an indeterminate series of relationships of identical content, and because according to established jurisprudence, a clause providing for informal arbitration lacks arbitral character or in any case does not derogate from the jurisdiction of judicial authority.
