Legal Principle
An arbitration clause providing for recourse to a sole arbitrator with decision ex bono et aequo constitutes a valid arbitration agreement pursuant to article 808 of the Code of Civil Procedure, establishing the lack of jurisdiction of the ordinary court over the dispute referred to the arbitrator.
In consortium disputes governed by regulations providing for mandatory arbitral proceedings for the resolution of disputes relating to technical assessments, arbitration is binding and precludes ordinary jurisdiction, save for the exceptions expressly contemplated for liquid and enforceable claims.
