Legal principle
An award in contractual arbitration (arbitrato irrituale) rendered at the conclusion of the arbitral procedure provided for in the contract and accepted by the parties, with the appointment of the third member by the President of the Court in the event of disagreement between those designated, definitively binds those who took part in it, who may not call in question before the courts either the determination there made or the ownership and allocation of the debt so determined.
A party which took part in the contractual arbitration procedure and signed the concluding minutes may not contest in court matters already examined and disposed of in those proceedings.
