An arbitration clause contained in an agreement for the grant of management rights over a municipal sports facility, entered into between a territorial public body and a private party, cannot be deemed operative in the absence of prior authorisation by the defendant public administration, such authorisation constituting a prerequisite for the admissibility of the arbitration application pursuant to Article 241 of Legislative Decree No. 50/2016.
