Court of Appeal of Venice, 26 August 2025, No. 2717
Corte di Appello
di Venezia
Legal Principle
The assignee of a claim arising from a contract containing an arbitration clause does not acquire title to the distinct and autonomous arbitration agreement and cannot invoke said clause against the assigned debtor, since the legitimatio ad causam (standing to sue) of the parties to arbitral proceedings presupposes that the parties to the proceedings are the same as those who entered into the contract and the arbitration clause.
