For the grant of suspension of the executory effect of an arbitral award pursuant to Article 830, final paragraph, of the Code of Civil Procedure, the court hearing the challenge must evaluate, in addition to serious grounds, also aspects of periculum in mora, verifying elements such as the unsuitability of the debtor applicant to meet his own debt, the possibility of receiving serious damage from performance, the existence of a solid framework of crisis and potential future insolvency of the creditor company, taking account also of the amount of the sum that is the subject of the dispute.
