Legal Principle
The suspension of the effectiveness of an arbitral award pursuant to Article 830 of the Code of Civil Procedure is subject to the existence of "serious grounds", a requirement which may be assessed by applying by analogy the parameters set out in Article 283 of the Code of Civil Procedure relating to the suspension of the enforceability of judgments. In particular, the requirement of manifest merit in the challenge, to be understood as manifest nullity of the award, is satisfied when the arbitral decision is affected prima facie by serious and incurable defects or contains evident errors.
