Court of Appeal of Palermo, 9 October 2025, No. 1421
Corte di Appello
di Palermo
Legal Principle
An arbitration clause contained in a contract maintains its effectiveness and extends arbitral jurisdiction to all disputes arising from the contractual relationship when the arbitral award has declared the claim for termination unfounded and established the continuing validity of the contractual bond.
Pursuant to Article 808 quater of the Code of Civil Procedure, in case of doubt the arbitration agreement must be interpreted in the sense that arbitral jurisdiction extends to all disputes arising from the contract or relationship to which the agreement refers, including questions relating to the validity of the contract itself.
