The contractual expert determination provided for in insurance policies, aimed at quantifying damage through the intervention of experts appointed by the parties, is to be distinguished from contractual arbitration (arbitrato irrituale) and constitutes a technical assessment which, whilst producing binding effects between the parties within the limits of the contractual agreement, does not amount to an arbitral decision in the strict sense.
