For the purposes of the stay of the enforceability of an arbitral award challenged pursuant to Article 830 of the Code of Civil Procedure, it is necessary that the challenge does not appear, on a preliminary summary examination, to be manifestly unfounded and that there exist substantiated serious grounds making the stay appropriate, which may also be assessed in light of the financial solidity of the party that prevailed in the arbitral proceedings, such as to guarantee the possible restitution of any sums recovered through enforcement.
