Court of Appeal of Catania, 11 February 2026, No. 207
Corte di Appello
Legal Principle
Where an arbitration clause contained in a set of regulations expressly excludes certain disputes from the scope of the referral to arbitration, those disputes fall outside arbitral jurisdiction and within the jurisdiction of the ordinary court, in accordance with the principle that the objective scope of the arbitration agreement is delimited by the will of the parties as ascertained from the construction of the clause itself.
