Legal Principle
Article 830, paragraph 4, of the Code of Civil Procedure does not rigidly define the prerequisites for suspension of the executory effect of a challenged arbitral award, merely requiring the existence of "serious grounds" (gravi motivi), the subsistence of which must be assessed through a prognostic evaluation that considers both the fumus boni iuris of the challenge and the periculum in mora arising from execution of the award.
