Legal Principle
The waiver of an appeal against an arbitral award (lodo) stands in perfect parallelism with the waiver of a claim in first instance proceedings and differs from the waiver of procedural acts in appellate proceedings, inasmuch as the latter is effective only if accepted by the opposing party or when acceptance is not required, whereas the waiver of an appeal against the award operates to divest the judge of the power and duty to issue a judgment with immediate effect, without requiring acceptance, and brings about the cessation of the subject matter in dispute with regard to the grounds of the appeal.
