Legal Principle
The objection to the jurisdiction of the ordinary court in favour of the arbitral tribunal, based on an arbitration clause contained in the contract underlying the claim, cannot be upheld where the claim brought by way of payment order proceedings is founded on a private law contract and the related dispute falls within the ordinary jurisdiction.
